MARTINSBURG, W.Va. -- A former Martinsburg city councilman will spend up to five years in prison on drug charges.
Fifty-one-year-old Frank Idoni was sentenced Monday in Berkeley County Circuit Court to one to five years for a single count of conspiracy to deliver crack cocaine.
Idoni's lawyer, Mark Sutton, asked for a sentence of home confinement or probation, arguing that Idoni's deteriorating health -- which has included the amputation of a leg -- makes prison a burden on the state and Idoni.
Judge Gray Silver III, though, said Idoni's crime came while he was on probation from a 2005 drug conviction, and therefore he should spend time in prison.
Sutton said Idoni has not yet decided whether he'll appeal.
