State Medicaid office target of lawsuit

CHARLESTON, W.Va. - A Charleston public interest law firm plans to file a lawsuit against the West Virginia Medicaid office, alleging that the agency's revamped government-funded health insurance program penalizes poor children.

Mountain State Justice says the state Medicaid office has repeatedly violated federal law and subjected families to a confusing benefits package that limits services to kids.

The law group plans to file the suit on behalf of two Medicaid-covered children, according to a letter sent earlier this month to the state Department of Health and Human Resources. The letter notified the department of Mountain State Justice's intent to sue sometime after 30 days.

"The Medicaid redesign is being administered in a way that's failing to provide children with essential health care as required by federal law," said Bren Pomponio, a lawyer with Mountain State Justice.

A Medicaid spokeswoman said Monday the agency doesn't comment on pending litigation.

However, the Medicaid office continues to defend the revamped program, which allows recipients to sign "personal responsibility" agreements to improve their children's' health in exchange for expanded benefits.

"Nobody's being denied medically necessary services," said Shannon Landrum, legislative liaison for West Virginia Medicaid.

Medicaid provides health care coverage to about 30 percent of all children in the state.

Last August, two organizations - Georgetown University's Center for Children and Families, and a health care consumer group called Families USA - issued separate reports that sharply criticized West Virginia's redesigned Medicaid program. Both groups alleged the program - called "Mountain Health Choices" - was failing the state's poorest children.

WOW, how one sided that comment was. They are NOT complaining about the Medicaid they are suing because they are being LIED to! I have had this issue as well. I work full time and I go to school full time and I have a full family but we dont get insurance through work and we just dont make a whole lot of money right now, especially with the economy! My kids have medicaid, so that means that they should take them away from me? I pay taxes just like you do!!! I feed them, cloth them, teach them, and raise them VERY well!!!! not that EVERYONE is like that but still, you REALLY underestimate people man!! Just because someone makes more money than me and pays more taxes than me doesnt mean my children or anyones children for that matter deserve to have less coverage than their children or than them!!! NO ONE IS BETTER in this situation. And remember just because it is medicaid doesnt necessarily mean it is FREE, there are somethings that we pay for!!

I don't think the DHHR is failing these kids--their parents are! When taxpayers are providing your medical coverage, I don't think it's too much to ask parents to take their child for regular check-ups, instead of allowing issues to progress and paying for repeated ER visits.
It doesn't appear they are asking for parents' to part the Red Sea--just to take responsibilty for their own children's well-being! The coverage and services are available--don't blame the DHHR if the parents aren't responsible enough to utilize them! Don't sue the DHHR---take the kids away from the parents!
If you are getting free medical coverage for your child--appreciate it and stop whining!

I guess the lesson here is that a parent who isn't responsible should not have any children.
