The Virginian Pilot reports that Bedford County Circuit Judge James Updike on Tuesday granted the defense's request to move Wesley Earnest's trial because of publicity surrounding the case.
While the trial will be held in Amherst County, the jury will be comprised of Nelson County residents.
Earnest was convicted in April in the 2007 shooting death of Jocelyn Earnest. Updike threw out the conviction in July because jurors had admitted they saw Jocelyn Earnest's journals.
Jocelyn Earnest graduated from West Virginia University and was a member of the Mountaineer women's basketball team.
