MARTINSBURG, W.Va. -- The Berkeley County grand jury has indicted a Martinsburg man accused of shooting another man and an 8-year-old girl at a Fourth of July celebration.

Media outlets report that a 12-count indictment handed up Tuesday charges Daniel Lee Herbert with attempted murder, wanton endangerment and related charges.

Police say Gabriel McGuire was shot twice in the back and the girl was shot in the leg during the event at War Memorial Park. Their injuries weren't life-threatening.

A witness told police that McGuire and Herbert were arguing when the shooting occurred. Police say the girl was a bystander.

Herbert remains in custody at the Eastern Regional Jail on $300,000 bond.
