Feds sue Morgantown company over failure to pay overtime

MORGANTOWN -- The U.S. Department of Labor says a Morgantown company that cares for mentally disabled people has refused to pay 11 employees overtime for more than three years.

A complaint with U.S. District Court in Clarksburg asks Judge Irene Keeley to order RSCR West Virginia Inc. to start paying overtime and to award workers an unspecified amount of back pay.

RSCR is a subsidiary of Kentucky-based ResCare Inc. In Morgantown, it operates as ResCare North Central Agency.

ResCare didn't immediately comment Monday.

The complaint says ResCare Morgantown was informed its practice was illegal. But it's continued since February 2009, with employees who weren't in administrative, executive or otherwise exempt positions.

The complaint also says ResCare has failed to maintain adequate, accurate records of workers' wages, hours and other conditions of employment.
