The court on Tuesday approved McHugh's reinstatement to senior status a week after his retirement.
Retired judicial officers who wish to be appointed to serve on senior status must apply for the position.
McHugh served two stints on the court, winning 12-year terms in 1980 and 1992.
He retired in 1997, was appointed to the court in 2009 and was elected the following year to a two-year term to fill the unexpired term of the late Justice Joseph Albright.
