Va. man not guilty in Martinsburg shooting death

MARTINSBURG, W.Va. -- A 41-year-old Virginia man has been found not guilty in the fatal shooting of another Virginia man in West Virginia nearly two years ago.

The Martinsburg Journal reported that jurors found Jonathan Frederick Bennett not guilty of felony murder Thursday in the March 2011 death of 26-year-old Geronimo Garcia-Cruz, of Winchester, Va.

Bennett was tried in Berkeley County Circuit Court. Jurors also found the Charlottesville man not guilty of assault during the commission of a felony, but found him guilty of unlawful assault.

Bennett testified he accidentally shot Garcia-Cruz during an altercation at the Martinsburg apartment of his girlfriend at the time.

Bennett is already serving an unrelated federal prison sentence.
