Repeal of Wheeling police cruiser law upheld

WHEELING, W.Va. -- A judge has upheld Wheeling voters' repeal of a city ordinance requiring two police officers inside each cruiser.

Ohio County Circuit Court Judge Ronald Wilson's ruling came Monday in a lawsuit filed by the Fraternal Order of Police Lodge 38.

The Intelligencer and Wheeling News-Register said the police lodge contended that the repeal was invalid. Its lawsuit said the City Council introduced legislation placing the issue on last November's ballot at a special meeting without sufficient public notice.

According to the lawsuit, the meeting was held at noon. An ordinance in effect at the time required regular meetings to be held at 7 p.m.

Wilson said in his ruling that the city did everything possible to notify the public of the meeting.
