The Kanawha-Charleston Health Department issues non-critical and critical violations. Critical violations are given to incidences that relate directly to the protection of the public from food-borne illness. The incidences are not negotiable and must be corrected immediately. Repetitions of critical violations may lead to enforcement actions or permit suspension. The following restaurants were rated, and the number of critical violations issued are included:

Villa Inc., 4900 SE Staunton Ave.: 12 critical violations on May 14. Inspector's comments: The person in charge is unable to demonstrate knowledge of food safety; employee observed not washing hands and changing gloves before returning to work with food after picking up towel off floor; employee observed not washing hands before putting on gloves; food employee handling cut lemons with bare hands, lemons for customer drink; food employees not wearing gloves in kitchen, handling ready to eat food; food in walk-in cooler is improperly date marked, tamales, cooked beef; containers used to store food in, not food grade; can-opener not clean to sight; chemical spray bottle not labeled; chemical spray bottles stored on food shelf in dry storage; chemical spray bottle stored hanging on prep sink. Upon re-inspection on May 28, the restaurant received 2 critical violations.

China Gourmet, 34 RHL Blvd., South Charleston: 11 critical violations on May 14. Inspector's comments: The person in charge is unable to demonstrate knowledge; employee observed not washing hands after touching dirty dishes at dishwasher and before touching clean dishes; observed cross contamination; raw meat stored above ready to eat food in walk-in; chicken was reheated to a temperature of 112 degrees F; shell eggs 57-degrees F, thrown away; spring rolls on steam table, 110 degrees F; Food in walk in is improperly date marked; food service is visibly soiled; shrimp thawing in mop sink thrown away; no indirect drain on food prep sink; evidence of pests as demonstrated by droppings, chew marks, etc., was observed in area; live mouse found under grill; working containers of cleaning chemicals not labeled with contents. Upon re-inspection on May 24, the restaurant received 2 critical violations.

Texas Steakhouse & Saloon, 103 Alex Lane: 9 critical violations on May 15. Inspector's comments: Drinking cup without cover was observed in food preparation area; moldy sliced tomatoes on prep line; raw shrimp stored above cooked ribs in walk-in cooler; cooked mushrooms plate stored on baking pan with raw hamburgers in reach-in cooler; hood fixtures, around outside of hood not clean to sight; bar fountain pop guns not clean to sight; ice machine not clean to sight; slicer not clean to sight; chemicals stored on shelf with food items. Upon reinspection on May 17, the restaurant received 2 critical violations; and follow-up inspection on May 21, received no critical violations.

Hooters, 5615 MacCorkle Ave. S.E.: 8 critical violations. Inspector's comments: Employee observed not washing hands before putting on gloves; barbecue beef in walk-in cooler moldy; food employee touching cheese while panning up without gloves; salad prep cooler above 41 degrees F, Thousand Island dressing 53 degrees F; low-boy prep cooler above 41-degrees F, hamburger 48 degrees F; trash bags used to line flour containers, not food grade; ice machine not clean to sight; chemical spray bottles not labeled. Upon re-inspection on May 24, the restaurant received 1 critical violation.

Sweet Dreams Pastry Shop, 1101 Second Ave., Montgomery: 7 critical violations on May 20. Inspector's comments: Employee observed not washing hands before putting on gloves; employee was observed eating in kitchen; food employee making chicken salad with bare hands; raw ground beef stored touching packages of deli meat stored above cabbage; hot dog chili, coleslaw improperly date marked; can-opener not clean to sight; hand sink in bad repair, small stream of water.
