Pleasants County man pleads guilty in infant son's death
MORGANTOWN, W.Va. -- A Pleasants County man has pleaded guilty to voluntary manslaughter in the 1981 shaking death of his infant son.
Special prosecutor Luke Furbee said Richard Allen Poore received a one- to five-year sentence under the law in effect in 1981. Poore received credit for time he already has served and was released from custody.
Poore entered his plea Monday in Monongalia Circuit Court. The case was moved to Monongalia County after Poore requested a change of venue.
Poore was charged in 2006 in the death of his son, Richard Poore Jr., after new information came to light. He was convicted of first-degree murder in 2008 and sentenced to life without mercy.
The state Supreme Court overturned the conviction in 2010.
Poore said in a statement that he was innocent, noting that an investigation and autopsy conducted in 1981 concluded that there were no grounds for any criminal charges.
He said that he accepted the plea because he does not believe he can get a fair trial.
He also said that his elderly mother told him that if he goes back to jail, "she goes back to jail.''
