Lawsuit claims driver negligence on school bus
CHARLESTON, W.Va. -- A bus driver's negligence caused an 8-year-old child's head to get smashed in the door of a school bus, a lawsuit filed this week claims.
The mother of an Alum Creek Elementary School student is suing the Kanawha County Board of Education over the 2011 incident.
While the child was exiting the bus, the bus driver closed the door and compressed the child's head between the school bus door and the frame of the school bus, according to the complaint.
The 8-year-old suffered serious and permanent injuries as a result, according to the lawsuit, as well as embarrassment and humiliation.
Jim Withrow, the school board's attorney, couldn't immediately be reached for comment. The mother and child are each identified only by their initials, M.S. The lawsuit was filed in Kanawha Circuit Court and assigned to Judge Jennifer Bailey.
