"This is a busload of lobbyists," he said. "You're holding a reception. You're talking to legislators."
Sutton proposed laying over the opinion for further study, but commission executive director Joan Parker that would leave the requestor and many other groups that host "Days at the Legislature" in legal limbo.
"We've never gone down this road before for these Days at the Legislature, whether it's county Day at the Legislature or Arts Day at the Legislature," she said.
"I don't know what can of worms is going to open. There's a subject day almost every day of the Legislature," Parker added.
According to the legislative activity calendar, there are at least 36 "Days at the Legislature" scheduled for the 2014 regular session, including four County Days, for Preston, Tucker, McDowell and Wyoming counties.
Ultimately, the commission approved the advisory opinion allowing the county group to solicit funds for the event on a 4-3 vote.
