Bail lowered for one of four charged in robbery-beating of Hurricane man

WINFIELD. W.Va. -- A Putnam judge lowered the bail Wednesday for a man arrested in connection to the robbery and beating of a Hurricane man.

Circuit Court Judge O.C. Spaulding approved a motion to lower Justin Paxson's bail from $75,000 to $10,000.

Paxson, 20, was one of four people charged with beating and robbing Corey Smart, 24, and leaving him on the side of Cow Creek Road in Hurricane on Sept. 9. Smart suffered two fractures to his skull.

As part of a condition of the new bond, Paxson will remain on home confinement and have no contact with the victim if he posts bail.

Paxson, Christina Mae Stover, 19; Robert Franklin Stover Jr., 23; and Roland Leonard Tate II, 23; have been charged with malicious wounding, first-degree robbery, conspiracy to commit robbery and conspiracy to commit malicious wounding.

Robert and Christina Stover are siblings. Their father is Frank Stover, chief of the Hurricane Volunteer Fire Department.

All are still being held at the Western Regional Jail. Christina and Robert Stover and Tate's bail amounts are set at $75,000 each.

Why?,
I guess the prosecution needed a patsy. According to a criminal complaint, "Tate and Paxson allegedly attacked him from behind". This seems like an easy win for the prosecution. The reporter needs to ask more questions and Circuit Court Judge O.C. Spaulding has some explaining to do to the citizens and taxpayers in Putnam County.
