The charge was dropped against Michael C. Boardman, 20, on Friday during a preliminary hearing in front of Magistrate Scot Lawrence.
Two felony charges against Boardman -- possession with intent to deliver and distribution of a controlled substance -- were sent to the grand jury, along with a misdemeanor charge of contributing to the delinquency or neglect of a child.
On Jan. 1, according to a criminal complaint written by State Police, Boardman and a 15-year-old girl were pulled over near the 7-Eleven store on W.Va. 817 in the Scary Creek area.
Police wrote they could smell marijuana and after searching the car found marijuana and materials used to sell it.
Boardman allegedly told police, according to the complaint, that he had been in a relationship with the teenager for about six months and had sex with her "many times." The complaint noted Boardman said the girl's mother was aware of the relationship.
"Boardman also explained that he and the female juvenile use marijuana daily and that he provides her with marijuana," the complaint states.
West Virginia's age of consent for sex is 16 for females.
