CHARLESTON, W.Va. -- Police say a West Side homeowner shot a Culloden man after he found him half-naked eating at his kitchen table Saturday morning.

Jack Boggess, of 7th Avenue, called Kanawha County Metro 911 around 3 a.m. and told dispatchers he shot Darin Lanning, 33, in the shoulder after he found him in his kitchen, according to a criminal complaint filed in Kanawha County Magistrate Court.

Lanning had allegedly kicked in Boggess' door and entered his home, the complaint states. Lanning had taken off his cowboy boots, jeans and coat, and was closing the refrigerator door when Boggess was woken up, Charleston Police wrote in the complaint.

According to police, Boggess pointed the gun at Lanning and ordered him to the ground. Lanning, the complaint states, took two steps toward Boggess "in a threatening manner." Boggess then shot him and held him at gunpoint until police arrived.

Lanning was conscious when police arrived and told them he thought he was in Hurricane at a friend's house.

Earlier that morning, around 1 a.m., Hurricane police had arrested Lanning at the Creek Side Bar, where they had found him lying face down in the parking lot, the complaint states. He had been taken to an alcohol treatment facility in Charleston and apparently walked away, according to police.

Lanning had a .276 blood alcohol content. The legal limit is .08.

Lanning is charged with felony burglary. He was treated at CAMC General Hospital for the gunshot wound before being taken to the South Central Regional Jail. His bond was set at $25,000.

Charges have not been filed against Boggess. Police wrote in the complaint he acted in self-defense.
