St. Albans man charged in horse shootings

ST. ALBANS, W.Va. -- A St. Albans man faces felony charges after he allegedly fired an assault rifle that killed one horse and maimed another earlier this week.

Kanawha County Sheriff's Department Cpl. Brian Humphreys said Delmar Dean Lacy II, 39, was charged on Thursday with malicious killing of an animal in connection to a shooting incident Sunday.

Deputies responded to reports of shots fired along Lower Falls Road around 5 p.m. Sunday. Humphreys said they found about 30 fired shell casings from a .223 caliber assault-rifle. Multiple callers to 911 identified Lacy as the shooter, Humphreys said.

Deputies originally charged Lacy with firing a weapon within 500 feet of a dwelling, a misdemeanor. However deputies later responded to reports of two horses killed and wounded from gunshots near Lacy's house. The horses' caretaker valued the dead horse at about $2,500 and the wounded horse at $2,000, Humphreys said.

Kanawha County prosecutors asked police to upgrade Lacy's charges related to killing a horse, cow or animal valued more than $100. Lacy turned himself in Thursday morning to Kanawha County Magistrate Court. He was later released on a $5,000 property, or 10 percent cash, bond.

He faces up to 10 years in prison if convicted.
