Man who stole car with baby in it to go to trial
CHARLESTON, W.Va. — An Elkview man accused of stealing a car with a baby inside will go to trial Monday after backing out of a deal with prosecutors.
Christopher Linville, 20, was arrested in January about a quarter-mile away from the Exxon One Stop on Washington Street, where police say he stole a car belonging to a woman who had gone into the store for coffee.
Police located the car with the 10-month-old inside on Wertz Avenue about an hour after the incident. The child was not harmed, according to police.
Linville is charged with possession of a stolen vehicle and child neglect creating a substantial risk of serious bodily injury and death.
Kanawha County assistant prosecutor James Bailey said Friday that Linville had said he would plead guilty to the child neglect charge. But during a hearing, he backed out of the deal with prosecutors, according to Bailey.
The trial is set before Kanawha Circuit Judge Duke Bloom.
