Parents charged in connection with death of two infants

By Staff reports

Two Fayette County parents were charged Tuesday in connection to the deaths of their two children at a mobile home park in Hilltop in March.

On March 11, deputies went to the home of Kyle Ralph Penson, 27 and Ashley Nicole Penson, 24 at the Mountaineer Mobile Home Park in Hilltop after getting 911 calls that two of the three children who lived at the home were unconscious and not breathing, Fayette County Sheriff Steve Kessler said in a statement. Both infants were taken to Plateau Medical Center, in Oak Hill, where they were pronounced dead, Kessler said.

Kessler said both bodies were sent to the state medical examiner, who concluded the infants died as a result of being rolled on by their parents during the night.

Kessler said both parents told police they had drunk alcohol or taken drugs the previous night before going to sleep on the living room floor with their three children. The third child was not hurt.

Kyle Penson and Ashley Penson were each charged with a felony count of child neglect resulting in death. The couple was awaiting arraignment Wednesday afternoon in Fayette County Magistrate Court.

“It’s very easy for an adult to roll over in his or her sleep and restrict an infant’s breathing,” Kessler said. “According to the criminal complaint, both parents admitted that they consumed alcohol and/or drugs before lying down in the floor to sleep with these young children.

“This significantly increased the risk factor for these children, as the chemically enhanced stupor of the parents made it less likely that they would have been awakened by the distress of these infants as their oxygen supply was reduced through parental overlay,” he said.”This is why both parents have been charged with the felony offense of child neglect resulting in death.”
