State Supreme Court accepts fewer appeals
Justices spend almost four months 'in vacation'

CHARLESTON, W.Va. - The West Virginia Supreme Court is refusing to hear as many legal appeals as it has in the past, according to court statistics - and two Supreme Court candidates say that should change.

The court accepted 41 percent of the appeals it reviewed in 1999 and 52 percent in 2000, according to the Supreme Court's "2007 Statistical Report."

Those percentages were 11 percent in 2006 and 17 percent in 2007.

    By not hearing a case the Supreme Court is ruling on the case. They are agreeing with the lower court. So, what's the problem. We are not silent, we understand.

    I bet the conservatives below don't have the nerve to mention their names!

    The Supreme Court's refusal to take worker's compensation appeals is a form of health care--or in point of fact the lack thereof;

    The vast majority of such appeals are from injured workers--not big business;

    They only appeal to the Court when they know they'll win;

    The harm done by Maynard and Blankenship is immeasurable in terms of worker's rights and protecting families from the hazards of the workplace;

    Who was it that said you'll always have Tories among us!

    Bravo Kevin you have the guts of a true coal man--not these lackies!

    You'll probably get edited out but please oh please don't back down an inch;

    It's rough out here sparring with these conservative jerks who even stand up for Maynard in is inglorious defeat;

    They have no shame and like the guys below they're attorneys on the take at some of Charleston's big coal defense law firms shilling for their dimes and quarters while the state goes broke!

    Not a lawyer but educated enough to know that a court's 'refusing to hear an appeal' doesn't mean that significant work or consideration was not done. Is this not the typical way the high court would support a lower court's ruling?

    Judge Darrell V. McGraw, Jr. was also elected to the Supreme Court in 1976 with Thomas Miller and Sam Harshbarger, and became known as the "three warlords for justice" in West Virginia; they dramatically reformed the Court and opened the doors for litigants to have their cases heard on appeal; Justices Albright and Starcher have followed closely in this once bold initiative to bring a "working court" home for the benefit of the people of West Virginia; candidates Ketchum and Workman are of this same proud traditional!
